1. Acceptance of Terms

By accessing and using MockupStack ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

MockupStack is an online software-as-a-service (SaaS) platform that allows users to create, customize, and export high-quality device mockups using browser-based visual design tools and API rendering technologies.

3. Subscriptions, Payments & Billing

We offer both free features and paid subscriptions (PRO plan). By subscribing to our PRO plan, you agree to pay all applicable fees. All payments are processed securely through our authorized payment processors, including Cryptomus and Creem. All transactions are billed in USD or supported cryptocurrencies.

You can cancel your subscription at any time through your Account Settings. Upon cancellation, your access to PRO features will continue until the end of your current billing cycle.

4. User Accounts & Security

To access certain features of the Service, you must create an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

5. Acceptable Use Policy

You agree not to use the Service for any unlawful purpose or in any way that could interrupt, damage, or impair the Service. Prohibited activities include, but are not limited to:

• Using scrapers, bots, or automated systems to bypass our security measures or download assets without authorization.
• Uploading content that violates intellectual property rights or is offensive, illegal, or harmful.
• Attempting to reverse engineer or modify the Service's source code.

6. Intellectual Property & Ownership

All rights, title, and interest in and to the Service (excluding user-uploaded screenshots) are and will remain the exclusive property of MockupStack and its licensors. Users retain all intellectual property rights to the screenshots they upload, and MockupStack does not claim any ownership over user-uploaded content.

7. DMCA & Intellectual Property Takedown Policy

MockupStack respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and applicable intellectual property laws, we will respond promptly to valid takedown notices.

If you believe that content captured, processed, or displayed through our Service infringes your copyright or other intellectual property rights, please submit a takedown request to [email protected] with the following information:

• A physical or electronic signature of the copyright owner or authorized agent.
• Identification of the copyrighted work claimed to be infringed.
• Identification of the allegedly infringing material and its location (URL or screenshot).
• Your contact information (name, email, phone number).
• A statement of good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Upon receiving a valid takedown notice, MockupStack will investigate the claim and take appropriate action, which may include disabling access to the allegedly infringing content, removing the material from our systems, or suspending the responsible user's account. MockupStack reserves the right to share takedown notices with the affected user and relevant third parties as required by law.

MockupStack also maintains the administrative capability to block specific domains, URLs, or users from being processed by our capture engine at the server level in response to verified intellectual property complaints.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

In no event shall MockupStack, its affiliates, directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of the Service. Users are solely responsible for the content they capture, upload, or export using the Service. MockupStack acts solely as a processing conduit and does not assume any liability for user-generated or user-captured content.

10. Account Suspension & Termination

MockupStack reserves the right to suspend or terminate any user account at its sole discretion, with or without prior notice, in the following circumstances:

• Repeated or willful infringement of third-party intellectual property rights.
• Receipt of valid DMCA takedown notices or court orders related to the user's content.
• Violation of the Acceptable Use Policy or any other provision of these Terms.
• Engagement in fraudulent, abusive, or harmful conduct on or through the Service.

Upon termination for cause, the user's access to the Service and all associated data may be revoked without liability. Users who believe their account was terminated in error may contact [email protected] to request a review.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law principles. Any legal action arising out of these Terms shall be filed in the courts of Istanbul, Turkey.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date.
